RSMK涉外小课堂第二期——美国专利申请之发明人变更
对于美国的专利申请，无论是根据35 USC 111(a)提出的专利申请还是根据35 USC 371启动国际申请的美国国家阶段申请，应该包含提出权利要求的发明的发明人的姓名；尚未指明发明人姓名的，要进行修订加以明确[1]。在实践过程中，经常会有需要变更发明人的情况，本期课程简要介绍非临时美国专利申请和授权阶段的发明人变更事项[2]。

[1] 35 USC 115(a)：NAMING THE INVENTOR; INVENTOR’S OATH OR DECLARATION.—An application for patent that is filed under section 111(a) or commences the national stage under section 371 shall include, or be amended to include, the name of the inventor for any invention claimed in the application. Except as otherwise provided in this section, each individual who is the inventor or a joint inventor of a claimed invention in an application for patent shall execute an oath or declaration in connection with the application.
